Expungement of Criminal Records
This economy requires every advantage you can get while
looking for employment. If you have a criminal record,
you may be being discriminated against as a job applicant,
even though it is unlawful (however, it is often difficult
to prove). Why not stand out among your peers and
erase or delete your criminal record for good?
Webster's Dictionary defines "expunge" as "to strike out,
obliterate or mark for deletion." Criminal records may
be expunged as long as certain criteria are met. In
other words, if your criminal record is eligible, your
criminal record may be erased forever! We can work on
expunging your criminal record no matter where you live or
where the charges were filed (as long as the charges were
filed in Maryland).
For example, if you received a probation before judgment (PBJ)
in Ocean City and reside in Cumberland we can help. If
you received a nolle prosequi while in College Park and now
reside out of state we can help. As long as the
charges were brought in the State Maryland we can help you
expunge your record.
Expungement of criminal records depends on two very
important things: (1) the disposition of the charge and (2)
how long ago it occurred. If your criminal record
reflects a "guilty" verdict (even if you pled guilty), the
record CANNOT be expunged (except for minor nuisance crimes).
Having your criminal record expunged will allow you to rest
easy knowing that a prior mistake won't haunt you for the
rest of your life.
Expungement only removes one particular criminal record
arising from one incident, even if that one incident led to
multiple criminal charges. If you have multiple
incidents, they may not all be eligible for expungement.
If one of the charges from an incident resulted in a guilty
verdict or plea, the remaining charges of the incident may
not be eligible for expungement. As you can see, a
thorough review of your criminal record is in order.
If you are unsure of whether or not your criminal record can
be expunged, feel free to give us a call for a free
consultation! The expungement process takes
approximately 90 days to complete, so the sooner the
expungement is filed, the sooner your criminal record is
erased.
*** We do not handle criminal defense cases, we only
handle expungement of prior records. ***
Common Expungement Mistakes:
(1) The expungement must be filed at the
right time for it to be accepted. There are many
different rules as to "when" is the right time to file
for expungement.
(2) Disclosure of an expunged record.
If you were not convicted (not found guilty) and your record
was expunged, you can honestly say you were never
convicted of a crime.
We can help you expunge your criminal record:
Your criminal record MAY be expunged
if the disposition of your case resulted in:
- Acquittal
- Nolle Prosequi
- Probation before Judgment (except
DUI/DWI)
- Stet
Your criminal record MAY NOT be
expunged if the disposition of your case was guilty,
EXCEPT if the charge was for a specified nuisance crime.
