Copyright Law

The Proy Law Firm takes copyright matters seriously, as you should too.  Copyrights are valuable intellectual property assets not only for small businesses owners and entrepreneurs, but also individuals.

If you have ever wondered how to copyright a work it involves filing an application through the United States Copyright Office.  If filled out incorrectly, the copyright can be denied and the decision must be appealed to register the work.

There are many intricacies to copyright law, such as how to copyright a work and registering the work before you can file suit for copyright infringement.  The Proy Law Firm can help you file for copyright protection of your written works, movies, music, software, sculptures, photographs, artwork and choreographic dances to ensure that your works are given protections afforded to you by copyright  law.

Common Copyright Mistakes:

(1) Many individuals fail to properly register their works, thereby preventing them from filing a copyright infringement lawsuit and opening the door to various defenses, such as the "unintentional infringer" defense.

(2) There is a longstanding myth how to copyright your work by placing inside an envelope and mailing it to yourself to provide a date stamp (through the post office marks) to effectively copyright your work.  This does nothing except waste postage.

(3) By terms of the copyright statute, the duration of copyright protection is the life of the author plus an additional 70 years.  This means that every new copyright outlives the author, which means that the creator of the work must incorporate their copyrights into their estate planning.

(4) A business owner should have a work for hire agreement with an employee who creates copyrighted materials for the employer.  Without such an agreement, you have opened the door to expensive and time-consuming litigation to determine who owns the copyright to the work.

The Proy Law Firm can help you with the following copyright matters:

- Assignment of Copyrights

- Copyright Litigation

- Copyright Registration

- Estate Planning for Authors of Copyrighted Works

- Licensing Agreements

- Settlement Agreements

- Work for Hire Agreements
